No tax for trailers

I got a tax bill on my truck, town thinks it’s only work 17k and the trailer valve was $0. Last year I  paid little over $500…..last year I was little over $1200

The town budget and assessed values of all property within the town is what determines the mill rate. My house went up and my cars went down because the mill rate dropped but my home value increased . Over all my taxes went up the two percent or so which the towns people approved. It’s  all a game. Not paying tax on trailers will just increase the mill rate to fund the budget. They likely made the change so more people are inclined to not register trailers and ATVS out of state like Maine (trailers)  or Mass ( for ATVs)

So, I went to City hall this morning and asked about the exemption. They first asked what I use the trailer for, which brain fart I should have just said utility trailer stuff, but I said its a flat deck trailer and I mainly tow my car on it. She came back and said be cause its a car trailer and because its over 5k gross weight it does not fall under the exemption. I was going to argue the car trailer thing but I had nothing to back up the gross weight claim so I just said thats not how I read it as it I didn't see anbything about the gross weight and I would look into it more and come back if I found anything.  She was also on the phone asking someone else questions and she hung up so I imagine arguing with her would have gotten me no where as she wasn't the one making decisions. So now I need to look into it more and go back down maybe next week.
 
I read through the state statute and state definition of utility trailer and there is no mention of gross weight. Trailers for specifically hauling cars are registered as camp trailers. So, I'm just gonna send an email with all the legal info and hope it doesn't open a can of worms on the whole car trailer vs utility trailer thing.
 
I sent an email to the town with the state statute and trailer definition and got the following response:

The DMV has very limited descriptions for “trailers”  We have campers that are registered as utility trailers.  There are only two codes under DMV for any type of trailer, code 11 and code 31. So you see how it would be very difficult to extact. The use can not be commercial at all and the gross weight was an average that was talked about a lot when this law was first passed.  The law is silent on how to describe a utility trailer so it has been put in the hands of each assessor to determine those parameters and be consistent to their taxpayers.  A lot of towns are using gross weight or asking for photos of the trailers to determine the actual type of trailer.  You are able to go to the Board of Assessment Appeals in September to appeal this issue.  As of right now, I have to be consistent and stick to the parameters that I used when issuing an assessment on any and all trailers registered to Derby.  If you would like me to send you information for an appeal, let me know.


So, looks like I'll still be paying taxes on it.
 
I had to send pictures to the town of my trailer. 

I'm guessing because there was a flat deck and I told them I haul my jeep and garden tractor they didn't give me any problems.  No questions about what the gross weight was.
 
They valued my trailer at $0 this year. I'll have to check on the exemption to get the value of the truck down.

I just paid my tax bill on my 1999 TJ last week.  I just looked at the slip and they assessed the Jeep at over $1600 - bill was $55.

Maybe they will credit it towards next year?
 
Joe, sounds like derby is just ignoring the new law and taxing trailers. It would be interesting if you asked others in town if they got the exemption or not.

To an extent yeah. I get the argument that the description is vague which doesn't help my case either. I don't think the town would ever side with me as they already made a decision to not lose out on all the money from trailers and just losing out on some. I already posted on the town facebook page seeing if anyone else is going through the same thing and got no replies so unfortunately no mob to picket at the towns front steps. I really just need to move.
 
Last budget this spring in the town I work there was a lot of concern expressed about the new vehicle tax laws meaning less revenue for towns.  I wonder if that is in the minds of people making the calls in some towns this year.

I live in the wealthiest county in PA mill rate is almost CT high. Looking forward to moving when my kid gets out of school in a few years.
 
Our town had to pass their budget before we could get our tax bill.

I owe:
$0.00 on my trailer
$0.00 on our boat
$55.00 on the Jeep (without Classic plates)
And my truck (white one) was only $250.00.  That will definitely change next year.
